Participant Release

WHEREAS, LEWIS FISHING ADVENTURES (hereinafter referred to as the “Company”) provides video, audio and still photography recording of all activities provided (hereinafter referred to as the Adventures), BY BOOKING AN ADVENTURE WITH LEWIS FISHING ADVENTURES I (hereinafter referred to as the “Participant”) agree to all the terms and conditions of this PARTICIPANT RELEASE

1. The Participant hereby irrevocably grants to the Company, its licensees, agents, successors and assigns, the right (but not the obligation), in perpetuity throughout the universe and in all media either now or heretofore unknown, to use in any manner the Company deems appropriate, and without limitation in and in connection with the Adventures, by whatever means exhibited, advertised or exploited, the Participant's appearance in the Adventures, video of the Participant, still photographs of the Participant, recordings of the Participant's voice, any music sung or played by the Participant, and the Participant's actual or fictitious name.

2. The Participant hereby agrees not to assert or maintain against the Company, its licensees, agents, successors and assigns, any claim, action suite or demand of any kind or nature whatsoever, including but not limited to, those grounded upon invasion of privacy, rights of publicity or other civil rights, or for any other reason in connection with the Company’s authorized use of the Participant's likeness and sound in the Adventures as herein provided. The Participant hereby releases the Company, its licensees, agents, successors and assigns, and each of them, from and against any and all claims, liabilities, demands, actions, causes of action(s), cost and expenses whatsoever, at law or in equity, known or unknown, anticipated or unanticipated, which the Participant had, now has, or may have shall or thereafter have by reason, matter, cause or thing arising out of the Company’s use as herein provided.

3. The Participant hereby releases and forever discharges the Company, its agents, licensees, successors and assigns, from any and all claims, compensations, liabilities and damages arising out of the rights granted herein, or the exercise thereof, as provided by the terms of this Agreement.

4. The Participant is aware of the hazards and risks to his or her person and property associated with the Adventures. The Participant accepts this assignment with full awareness of these risks, and the Participant voluntarily assume all hazards and risks associated with the Adventures, and any damage to his or her personal property, and the Participant releases the Company and its agents, officers, directors, and employees from any liability whatever arising as a result of death, injury, or illness that the Participant may suffer as a result of participation in the Adventures.

5. If any provision of this Agreement shall be held to be invalid or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable.

I HAVE READ AND UNDERSTOOD THIS AGREEMENT PRIOR TO BY BOOKING AN ADVENTURE WITH LEWIS FISHING ADVENTURES AND I AM AWARE THAT BY BY BOOKING AN ADVENTURE WITH LEWIS FISHING ADVENTURES I AM WAIVING CERTAIN LEGAL RIGHTS WHICH I OR MY HEIRS, NEXT OF KIN, EXECUTORS, ADMINISTRATORS, ASSIGNS AND REPRESENTATIVES MAY HAVE AGAINST THE COMPANY, ITS LICENSEES, AGENTS, SUCCESSORS AND ASSIGNS.
